{"id":923,"date":"2021-05-25T17:21:54","date_gmt":"2021-05-25T16:21:54","guid":{"rendered":"http:\/\/www.centrepeople.com\/jp\/article\/?p=923"},"modified":"2025-02-07T13:14:03","modified_gmt":"2025-02-07T12:14:03","slug":"righttowork-immigration","status":"publish","type":"post","link":"https:\/\/www.centrepeople.com\/jp\/article\/righttowork-immigration\/","title":{"rendered":"May 2021 &#8211; Announcement of end of Covid adjusted right to work check"},"content":{"rendered":"\n<p>The Home\nOffice confirmed on 20 April 2021 that the COVID-19 adjusted right to work\ncheck process will only remain in place until 16 May 2021. Although employers\nwill need to undertake fully compliant right to work checks from 17 May 2021,\nthey will not have to carry out retrospective checks where the adjusted process\nhas been used.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><strong>No\nretrospective checks required<\/strong><strong><\/strong><\/p>\n\n\n\n<p>The confirmation that retrospective checks will not\nbe required will come as a relief to employers and recognises the huge\nadministrative task that would have been involved in doing this.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><strong>Employer\nreaction to the announcement<\/strong><strong><\/strong><\/p>\n\n\n\n<p>The ending of adjusted right to work process\ncoincides with the planned implementation of step three of the Government\u2019s\nroadmap&nbsp;for easing lockdown restrictions in England. However, many\nemployees will continue to work either fully or predominantly from home beyond\nthis date.<\/p>\n\n\n\n<p>Many employers have expressed concern that the\nreturn to full compliance is premature and unworkable. We, along with other\nimmigration practitioners, will be raising our clients\u2019 concerns with the Home\nOffice with a view to reaching a safer and less disruptive solution.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><strong>Tips for\nminimising adjusted checks and returning to fully compliant right to work\nchecks when required<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Whilst the appropriate arrangements will vary from\nbusiness to business, we would suggest the following general approach for\nemployers to ensure compliance whilst minimising the need for face-to-face\nright to work checks:<\/p>\n\n\n\n<ul><li>Determine an internal policy for conducting right\nto work checks on the assumption this will be required from 17 May 2021 and\nensure all relevant recruitment, HR and any other staff responsible for\ncarrying out right to work checks are made aware of this in good time<\/li><\/ul>\n\n\n\n<ul><li>Use online right to work checks wherever possible\n(noting that the individual must be present at the time of the check, at least\nvia live video link)<\/li><\/ul>\n\n\n\n<ul><li>Put adequate resources in place to securely\nreceive, review and return physical documents required for manual right to work\nchecks, and consider conducting manual checks with the individual being present\nvia live video link rather than face-to-face.<\/li><\/ul>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>The general reaction to this\npolicy change has been immediate and negative. There is a good chance the Home\nOffice will be lobbied to defer the resumption of fully compliant right to work\nchecks.
